    When selling a mobile home in Sarasota, who pays the tax?

    When we work with mobile home Buyers and Sellers in Sarasota, they oftentimes have many questions and concerns about how the closing is done when selling a mobile home on leased land.

    Have you been curious as to who pays the tax on a mobile home that’s sold on leased land?

    Wondering who the tax is paid to and for how much?

    We have learned that providing a thorough explanation to both the Buyers and Sellers about who pays what tax and when before the closing of a mobile home on leased land helps tremendously once the home is ready to be sold.

    Mobile homes on leased land are taxed in the state of Florida as personal property. This is the same way a boat or a vehicle is taxed. The reason for this is, is that the Buyer of this mobile home is just buying the home and renting the land underneath.

    If the Buyer were to buy the home and the land that sits on it, then the home would be viewed as real estate and not as a traditional personal property transaction.

    In the following example we’ll go over, I’ll assume that the transaction of the mobile home on leased land is being handled by a licensed, bonded, and insured mobile home broker within the state of Florida, such as we, at the Mobile Home Dealer.

    One of the huge advantages of working with a licensed mobile home broker is that one of our requirements by the state is to ensure proper transfer of title from the Seller to the Buyer.

    With this understanding, the tax on a mobile home on leased land is paid by the Buyer of the mobile home to the broker at the time of closing.

    This tax payment is then paid by the broker to the state of Florida on behalf of the buyer.

    When the mobile home is purchased in Sarasota County, the tax will be assessed at 7% of the total purchase price; 6% is paid to the state of Florida and 1% is a Sarasota County tax.

    When buying a mobile home on leased land in Sarasota County, all Buyers need to consider the 7% sales tax when making an offer on the mobile home.

    What is a 55+ Community?

    A mobile home park is much like a condominium or homeowners association where the common spaces are maintained by the park owners and staff and where tenants have a small lot that they care for.

    When a park is deemed to be a senior mobile home park (55-year-old+), they have rules about the minimum age of the people who live there. Most parks offer senior living for people aged 55 and older and do not permit those who are younger to live there.

    Both the Buyer and the Seller realized that the homes being sold are often, not brand new homes.

    Many homes in the market within the Sarasota area, especially in the age-qualified parks, are models from the 1970s and the 1980s. Here the Buyer realizes that there may be some common wear and tear on the home, as it is not a brand-new mobile home.

    We believe that most Buyers expect some dings and scratches within the home, but the main thing they are looking for is if the home is currently habitable in its current state. Is it clean? And is it safe?

    By habitable, I am referring to is the home livable as it sits currently, are the bigger repairs are already done, or do they need to be worked on right after the buyer buys the home.

    Does the air conditioner work without any issues? Is there any evidence of any water damage? Does the roof look good and in solid shape? Are the floors solid with very few, if any, soft spots? And are the appliances that come with the home in proper working condition?

    Most Buyers want the ability to buy the home, unload their suitcase, and immediately begin enjoying their new home without the requirement of a large repair bill in the immediate future.

    The home does not need to be professionally cleaned when it comes up for sale, but it does need to be picked up and straightened. Remember, you never get a second chance to make a first impression, so it is important to put your best foot forward when you put your home up for sale.

    The home does need to be safe right away. If there are any issues with the electrical or plumbing, make sure those are either fixed prior to having the home listed or at the very least tell your licensed mobile home broker that you are aware of the issues that exist, so the Buyer is informed prior to the purchase of your home.

    Why Live In A Sarasota Resident Owned Mobile Home Park?

    Have you ever wondered, what are the advantages of living in a resident-owned mobile home park in Sarasota?

    Are you curious as to what the differences are between a resident-owned mobile home park and a traditional park?

    I understand this gets pretty confusing if you’re not familiar with it!

    Are you ready to get those questions answered?

    Let’s begin!

    When looking at buying a mobile home you will first need to determine if you would like to buy the home and the land that the home sits on, or if you are okay with buying the home and renting that land.

    There are pros and cons to each decision here.

    Resident Owned Community (ROC) mobile home park, is a park owned and managed by a non-profit corporation formed by the homeowners. It is also called Cooperative, or in short, Co-op. Each member of the Co-op is part owner of the park and the land where each house sits. There are many benefits of living inside an ROC park compared to those owned by a single person, family, or company.

    A resident-owned mobile home park is a housing community in which the residents own and manage the park. This type of community is also known as a cooperative or a manufactured home community. In most cases, the residents of the park elect a board of directors to oversee the management of the property. The board is responsible for setting and enforcing rules, maintaining common areas, and ensuring that the property is well-kept. Residents typically pay monthly fees to cover the costs of these services.

    If you are looking to buy the home and the land, then you will be living in what is called a co-op mobile home park, which is resident-owned. Within these parks, you do not have lot rent each month since you own the land the home sits on, but will still have a monthly HOA payment that will cover the cost of the upkeep of the common areas and the amenities the park offers. The main positive about going this route is that since you own the ground, you can benefit from the land appreciation, just like a regular stick-and-brick home. Now, the downside of buying both the home and the land is that the initial costs will be much more expensive than that of a land-rented home. Many times it is about three to four times higher.

    If you’re looking to not spend as much money on your initial purchase, then looking at a traditional mobile home park where you buy the home and then rent the land will be a better option for you. In this scenario, you will be paying a monthly fee to the park for renting the land, this payment is called lot rent. This lot rent will help cover the cost of the upkeep of all the public areas, amenities, lawn mowing, and oftentimes additional utilities for your home, such as water, sewer, and trash pickup. Expect lot rent to increase by 3% to 5% per year. The con of buying in a traditional mobile home park when you don’t own the land is that you will not benefit from the land appreciation when you go to sell your home.

    Why Live In A Sarasota Resident Owned Mobile Home Park

    When looking at which option to go with, I have learned it is up to the buyer and how long they plan to live in that home.

    If they are looking to own the home for several years, then spending more on the front end to buy the land and the home may be a good idea as over time that monthly lot rent can add up fast. On the other side, if this is a few-year adventure, or if the buyer is not sure how buying a mobile home in Sarasota will work for them, then buying at a traditional park may be a better way to go as the initial buy-in is far less.

    Having said that, a ROC mobile home park has many advantages over a traditional park. This includes but is not limited to.

    • Control of monthly lot rent, community repairs, and improvements;
    • Lifetime security against unfair eviction;
    • Liability protection (Members are not personally liable for association loans.), and a strong sense of community.
    • Everyone has a say in the way the ROC is run, and major decisions are made by the democratic vote. Members elect a board of directors, which appoints committees to carry out various tasks and manage the day-to-day operations of the organization.

    Why ROC is different?

    In a commercially owned mobile home park, the owner controls the lot rent and the residents cannot do anything about it when the owner decides to increase the lot rent based on factors outlined in the prospectus. The owner also has control over the condition of the community – including roads, water, electricity, waste-water systems, and landscaping.

    Each time the park is sold to a new owner, the rent is likely to increase. With the ever-increasing lot rent, the theory is that, if you don’t agree with how the park is managed, or if you can’t afford the lot rent, you are free to move your house somewhere else. This is a problem for many homeowners though as aside from the massive cost of moving, it also becomes difficult to find land to where you can transfer your house.

    When looking at purchasing a mobile home in the Sarasota area, it is important to know what type of park you are looking at before shopping within it. Knowing if that park is a co-op resident-owned park or a traditional park will help you greatly in knowing exactly what you were looking at when viewing the mobile home for sale.

    If you had someone who is not licensed to help sell your mobile home, wouldn’t you save a ton of money by working with them?

    These are some of the questions I am asked on a regular basis when explaining The Mobile Home Dealer’s services to sellers who are wanting to sell their mobile homes.

    Selling your home is a big event in your life, and I feel you need someone you can rely on who will make sure that everything in the process is done correctly and to the letter of the law. I understand it may be tempting to try and have someone who is not licensed help sell your mobile home for you.

    Now, these individuals, the ones who aren’t licensed, may call you through your For Sale by Owner signs, or they might be friends of someone who lives in the park who says they can help.

    I have some advice for you if you’re looking to have one of these non-licensed individuals help sell your mobile home for you,

    DON’T DO THAT, OKAY?

    Here’s why.

    Although I am sure these folks mean well when the individual is not licensed, they have not gone through the stringent background check that the state of Florida requires you to pass in order to even submit your license application.

    Part of this process is the taking and passing of a state-mandated examination that goes over everything that has to do with the closing of a mobile home sale. If the home is not closed properly, and accurate taxes and fees are not paid to the state, then the sale might not be viewed as valid.

    What this means is that even though you thought you sold your home, you didn’t.

    Having a licensed mobile home broker sell your home, does come with a cost.

    But when all options are weighed, would you rather pay a licensed professional to sell your home, ensuring that the home is sold correctly with all taxes and fees paid so that you can move on with your life? Or would you rather try and save a few dollars, not even knowing if your home is really sold?

    When the time comes for you to sell your home, I would highly suggest you ask whomever you are looking to have to sell your home if they are licensed and ask them for a copy of their Florida state license as proof of this.

    What is For Sale by Owner?

    For Sale By Owner means itself. A property is being offered to sell by its owner without the help of a third party like an agent or broker.  How convenient can it be to sell a property through an advisor? The first thing one thinks of is the commissions and the money that one could save oneself without it, but if we place all the factors in a balance, it is worth rethinking the situation. We propose a list of 5 advantages and disadvantages that we recommend taking into account when making a decision as important as this.

    Advantages of For Sale By Owner

    • You will have greater profits since the commissions that would correspond to the agent can be saved (without considering the value of your time in the entire sales process)
    • You can do things in your way, for example: publish your sale announcement wherever you want and whatever you want (but if you do not review it frequently, you will not find out that there are people interested in your property)
    • You will have the opportunity to work at your pace, without coordinating activities with third parties (anyway, that could make some potential clients lose).
    • You will be in charge of selling only one property, so you will have more time than an agent who has other properties to sell.
    • You can establish your own game rule (but not necessarily your rules are accepted by the potential buyer. Probably a professional broker could establish a balance point and get the sale to be made).

    When I was working through all my new leads this week, I made over 150 calls to mobile home sellers looking to sell their mobile homes themselves.

    I found it very interesting, during all of these conversations, why sellers want to sell their homes themselves and how….. expensive it is to do that!

    My team and I found these homes for sale by seeing the sellers’ For Sale By Owner signs in their front yards.

    To recap, when a seller is looking to sell their homes on their own, they are, on average, paying the following amounts to do so:

    Bradenton $3,078, Sarasota $4,186, Venice over $7,500.
